How to File a First Appeal Before the State Commission (SCDRC)

Introduction

If you are aggrieved by an order passed by the District Consumer Commission (DCDRC), you have the right to challenge it by filing a First Appeal before the State Consumer Disputes Redressal Commission (SCDRC). This article explains the complete procedure.

Legal Basis

Section 41 of the Consumer Protection Act, 2019 provides that any person aggrieved by an order of the District Commission may appeal to the State Commission within 45 days of the date of the order.

Time Limit — 45 Days

The First Appeal must be filed within 45 days from the date of receiving the DCDRC order. If filing after 45 days, you must attach a Condonation of Delay Application explaining the reasons for the delay.

Step-by-Step Filing Procedure

Step 1: Obtain a Certified Copy of the DCDRC Order

Apply for a certified copy from the Registry or download it from the e-Jagriti portal.

Step 2: Login to e-Jagriti

Visit e-jagriti.gov.in and go to Dashboard — File a Case — First Appeal.

Step 3: Draft the Grounds of Appeal

Clearly mention why the DCDRC order is wrong. State the legal errors, factual errors, or jurisdictional issues. Grounds must be specific and legally precise.

Step 4: Upload All Required Documents

  • Certified copy of DCDRC order
  • Original complaint copy
  • Evidence filed before DCDRC
  • Condonation of Delay application (if applicable)

Step 5: Pay Court Fee and Submit

Pay the applicable court fee online. After payment, submit the appeal and note the Filing Reference Number.

Important Points

  • The appeal must be accompanied by the certified copy of the original order
  • Grounds of appeal must be specific — general dissatisfaction is not sufficient
  • If you are the Opposite Party, deposit any amount awarded by DCDRC (pre-deposit requirement)
