Introduction
A Revision Petition can be filed before the National Consumer Disputes Redressal Commission (NCDRC) against an order passed by the State Consumer Commission (SCDRC). This article explains the full procedure, legal basis, and important points.
Legal Basis
Section 58(1)(b) of the Consumer Protection Act, 2019 empowers the National Commission to examine any order passed by a State Commission for the purpose of satisfying itself as to the correctness, legality, or propriety of such order.
Time Limit — 90 Days
A Revision Petition must be filed within 90 days from the date of the SCDRC order. Delay beyond 90 days requires a Condonation of Delay application.
Grounds for Revision
- The State Commission exercised jurisdiction not vested in it by law
- The State Commission failed to exercise jurisdiction so vested
- The State Commission acted illegally or with material irregularity
Filing Procedure
Step 1: Get Certified Copy of SCDRC Order
Obtain the certified copy from the State Commission Registry or via the e-Jagriti portal.
Step 2: Login and Select NCDRC
Visit e-jagriti.gov.in — File a Case — Revision Petition — Select NCDRC.
Step 3: Draft Grounds of Revision
The grounds must focus on jurisdictional errors, legal illegality, or material irregularity — not just a simple factual re-appreciation.
Step 4: Upload Documents and Submit
- Certified copy of SCDRC order
- Certified copy of DCDRC order
- Original complaint and all evidence
- Condonation of Delay (if applicable)
