Common Consumer Problems Faced in Daily Life and Available Legal Remedies

Introduction

Every day, millions of consumers in India face problems with products and services — from a defective mobile phone to an unpaid insurance claim, from overcharging by a restaurant to a delayed flight. This article discusses the most common consumer problems and the legal remedies available for each.

1. Online Shopping – Product Not Delivered or Wrong Product Delivered

Problem: You paid for a product online, but it was never delivered, or a wrong/damaged product was delivered.

Remedy: File a complaint on the e-commerce platform’s grievance portal first. If unresolved, send a Legal Notice. Then file a consumer complaint at e-jagriti.gov.in.

Relief Available: Full refund + compensation for harassment + litigation costs.

2. Insurance Claim Rejected

Problem: Your health, vehicle, or life insurance claim was rejected on arbitrary grounds.

Remedy: Send a Legal Notice to the insurance company. File with IRDAI or the Insurance Ombudsman. Then file a consumer complaint.

3. Bank Charges – Unauthorized Deductions

Problem: Your bank has deducted charges without proper notice or contrary to agreed terms.

Remedy: File a complaint with the bank’s grievance redressal officer. If unresolved, approach the Banking Ombudsman under RBI. Then file a consumer complaint.

4. Medical Negligence

Problem: A doctor or hospital provided negligent treatment resulting in harm.

Remedy: Collect all medical records. Get an independent expert opinion. Send a Legal Notice. File a consumer complaint with supporting medical evidence.

5. Defective Electronic Products

Problem: A newly purchased mobile, TV, laptop, or appliance is defective and the company refuses to repair/replace it.

Remedy: Submit a written complaint to the service centre. Get the job sheet. If not resolved, send a Legal Notice. File a consumer complaint.

6. Builder/Real Estate – Delayed Possession

Problem: Builder has not delivered the flat/house even after the agreed date and full payment.

Remedy: File a complaint before RERA or the Consumer Commission. Both forums are available.

7. Overcharging / MRP Violation

Problem: A shop or restaurant charged more than the MRP or menu price.

Remedy: Collect the bill as evidence. File a complaint with the District Consumer Commission. Also file with the Legal Metrology Department.
