How to File a Review Application in Consumer Courts

Introduction

A Review Application is filed before the same Consumer Commission that passed the order, requesting it to re-examine its own decision. It is different from an appeal or revision — it is filed before the same forum, not a higher court.

When Can a Review Application Be Filed?

  • There is an error apparent on the face of the record
  • New and important evidence has come to light that was not available at the time of the original order
  • The order was passed without giving a hearing to one of the parties (violation of natural justice)

Time Limit

A Review Application must generally be filed within 30 days from the date of the order. Delay requires a Condonation of Delay application.

Filing Process

Step 1: Login to e-Jagriti

Login at e-jagriti.gov.in, go to your case, and file Review Application under Misc Application.

Step 2: Draft the Review Application

Clearly state the specific error in the order that you want reviewed. Attach any new evidence if that is the ground.

Step 3: Submit and Track

Submit the application and track the listing via the Cause List.

Important Points

  • A Review is not a fresh hearing of the case — it is a limited re-examination
  • A Review is not a substitute for an appeal or revision
  • If you have grounds for a review, also consider whether an appeal is more appropriate
