Buying a product that turns out to be defective is one of the most frustrating experiences a consumer can face. Whether it is a home appliance that stops working within days of the purchase, the packaged food items’ quality issue, or an electronic gadget that never matched its advertised feature, you as a consumer have every right to fight.

The good news is that India has strong consumer protection platforms like e-jagriti.gov.in, which have made it easier than ever for ordinary citizens to raise their voice and seek justice without hiring an advocate/lawyer. or spending thousands on legal fees.

What counts as a defective product?

Under the Consumer Protection Act, 2019, a product is considered defective if it has any fault, imperfection, or shortcoming in quality, potency, purity, or standards that must be maintained by law or claimed by the seller or manufacturer. This includes products that cause harm and do not perform as advertised, have missing parts or are sold with false labelling.

Common examples include. 

  • A mobile phone that stops charging after five or fewer days.
  • A mixer grinder that gives an electric shock.
  • A medical with wrong expiry date printed on the pack
  • Furniture that arrives broken or mismatched from the order
  • Footwear that tears within a weeks of use

The aggrieved person should take action before filing a complaint.

Before you approach the consumer forum/court or use the e-Jagriti portal, there are a few important steps you should take.

  • Contact the seller or company firstly and send a written complaint through email or registered letter. Please allow them 15 to 30 days to respond or address the issues.
  • Collect all the documents, including your invoice, warranty card, product photos, screenshots of online orders, and any communication with the seller, company, or manufacturer.

Note: The purchase date and the consumer court have time limits, so the consumer should act within two years of the defective goods being discovered. 

How to file consumer complaint using the e-Jagriti portal 

The Govt. of India has launched the e-jagriti platform (e-jagriti.gov.in) to allow consumers to file their complaints online and submit the original copy to the registry of the consumer court.

  1. Registered on the e-Jagriti portal: => go to the official portal at e-jagriti portal (e-jagriti.gov.in) click on Register/Login, and create your account using your mobile and email ID and official documents. Once verified, log in to your account.
  2. Choose the Right Consumer Commission => The consumer commissions in India are divided based on the value of the goods and the compensation claimed. The complaints up to 50 lakhs go to the District Consumer Dispute Redressal Commission (DCDRC) and Rs50 Lakhs to 2 crores go to the State Consumer Dispute Redressal Commission (SCDRC) and above 2 crores go to the National Consumer Dispute Redressal Commission (NCDRC). On the e-Jagriti portal, this tier is auto-suggested based on the amount you enter.
  3. Fill the complaint form on e-jagriti. => On the portal of the e-jagriti dashboard, click on ‘File new case’ and fill in details such as the name of the complainant and the name of the opposite party (seller/company) and complete address of the both parties. Please provide the nature of defects, the relief sought (refund, replacement, or compensation), the total claim amount, and attach all supporting documents in PDF format. Ensure that the documents are clear and readable, avoid emotional language, and focus on dates, amounts, and facts.
  4. Pay the complainant’s filing fee online. => e-Jagriti provides an integrated payment gateway. Filing fees are nominal and start at Rs 100 for claims under Rs 5 lakh. Payment can be done by the complainant through the UPI, net banking or debit/credit card.

What relief can you seek?

As a consumer, you can ask the court to order one or more of the following:

  • Full refund of the product price
  • Replacement with new defect-free products
  • compensation for physical or mental suffering caused by the defects
  • Payment of legal costs incurred during the complaint process.
  • Punitive damages in cases of gross negligence by the company.

The consumer always keeps original receipts safe and never throws them away after the purchase of products and taking services. Please draft your complaint in a logical sequence. what you bought, what went wrong, and what the company said.
